1. Introduction

These Terms and Conditions ("Terms") govern your use of NotionHabitHeroes ("Service", "we", "us", "our"), operated by Lucas Spiller, located at Nidderau, Germany.

By creating an account or using our Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Service Description

NotionHabitHeroes is a habit tracking application that integrates with Notion. The Service allows you to:

• Track daily habits within your Notion workspace
• View streaks, statistics, and progress
• Participate in competitions with other users
• Earn points and achievements

3. Account Registration

3.1 Eligibility

You must be at least 16 years old to use this Service.

3.2 Account Requirements

• You must provide accurate and complete information
• You must use a valid email address
• You are responsible for maintaining the security of your account
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access

3.3 One Account Policy

Each user may only maintain one account. Multiple accounts may be terminated.

4. Notion Integration

4.1 Authorization

By connecting your Notion workspace, you authorize us to:

• Access your designated habit tracking database
• Create and modify pages within that database
• Read habit completion data

4.2 Your Responsibility

• You are responsible for your Notion workspace configuration
• We are not responsible for data loss in your Notion workspace
• You may disconnect the integration at any time

4.3 Notion's Terms

Your use of Notion is subject to Notion's own Terms of Service. See Notion Terms and Privacy. We are not affiliated with Notion Labs, Inc.

5. Subscription Plans and Payments

5.1 Free Plan

The free plan includes:

• Unlimited habits
• Streak tracking
• Basic statistics

5.2 Pro Plan

The Pro plan (€3.99/month or €39.99/year) includes:

• Competition features
• Advanced statistics
• Priority support

5.3 Payment Processing

• Payments are processed by Stripe, Inc.
• You agree to Stripe's Terms of Service. See Stripe legal/imprint
• All prices include applicable VAT

5.4 Billing Cycle

• Monthly subscriptions renew every 30 days
• Yearly subscriptions renew every 365 days
• You will be charged automatically unless you cancel

5.5 Price Changes

We may change prices with 30 days notice. Price changes do not affect current billing cycles.

5.6 Service Delivery (Fulfilment)

• NotionHabitHeroes is a digital service with no physical delivery
• Upon successful payment, Pro features are activated instantly
• Access is provided via notionhabitheroes.com and the Notion widget
• Requires an active internet connection and a Notion account
• If you experience issues accessing Pro features after payment, contact us at contact@notionhabitheroes.com

6. Cancellation and Refunds

6.1 Cancellation

• You may cancel your subscription at any time
• Access continues until the end of your paid period
• No partial refunds for unused time

6.2 Free Trial

• New Pro subscribers receive a 14-day free trial
• Payment information is collected at signup but not charged during the trial
• You may cancel anytime during the trial without being charged
• If you do not cancel before the trial ends, your first payment will be processed automatically

6.3 Right of Withdrawal (EU Consumers)

By starting your free trial, you acknowledge that:

• You have 14 days to test the Service before any payment is processed
• You can cancel anytime during the trial in your account settings at no cost
• If you choose to continue after the trial, you request immediate access to the paid Service
• Continuing after the trial constitutes a waiver of your right of withdrawal, as the digital service is provided immediately upon payment

To cancel, go to Your Profile → Manage Subscription. No email required.

7. Acceptable Use

7.1 You agree NOT to:

• Use the Service for illegal purposes
• Attempt to gain unauthorized access to our systems
• Interfere with other users' enjoyment of the Service
• Upload malicious code or content
• Create fake accounts or impersonate others
• Abuse the competition system (e.g., multiple accounts)
• Reverse engineer or copy our Service
• Use automated scripts or bots
• Resell or redistribute the Service

7.2 Competition Rules

• Fair play is required in all competitions
• Manipulation of scores will result in disqualification
• We reserve the right to remove users from competitions

8. Intellectual Property

8.1 Our Property

The Service, including its design, code, features, and branding, is owned by us and protected by intellectual property laws.

8.2 Your Data

You retain ownership of your habit data. By using the Service, you grant us a license to process your data solely to provide the Service.

8.3 Feedback

Any feedback or suggestions you provide may be used by us without obligation to you.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee:

• Uninterrupted or error-free service
• That the Service will meet your specific needs
• The accuracy of statistics or calculations
• Compatibility with all Notion configurations

10. Limitation of Liability

10.1 To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for data loss in your Notion workspace or our Service.

10.2 Exceptions

These limitations do not apply to:

• Damages caused by intent or gross negligence
• Liability that cannot be excluded under applicable law
• Claims under mandatory consumer protection laws

11. Availability and Modifications

11.1 Availability

• We strive for high availability but do not guarantee uptime
• We may perform maintenance with or without notice
• The Service depends on third parties (Notion, AWS, Stripe)

11.2 Modifications

We reserve the right to:

• Modify or discontinue features
• Update these Terms with reasonable notice
• Change pricing with 30 days notice

11.3 Notification of Changes

Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.

12. Termination

12.1 By You

You may delete your account at any time through the application.

12.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the Service or other users

12.3 Effect of Termination

Upon termination:

• Your access to the Service ends
• Your data will be deleted (except as required by law)
• No refunds for prepaid subscriptions (unless required by law)

13. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

• Your violation of these Terms
• Your use of the Service
• Your violation of any third-party rights

14. Dispute Resolution

14.1 Informal Resolution

Before filing a legal claim, contact us at contact@notionhabitheroes.com to attempt resolution.

14.2 Governing Law

These Terms are governed by the laws of the Federal Republic of Germany.

14.3 Jurisdiction

• For consumers in the EU: You may bring claims in your country of residence.
• For all others: Exclusive jurisdiction is Nidderau, Germany.

14.4 EU Online Dispute Resolution

The European Commission provides an Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/

15. Miscellaneous

15.1 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

15.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement.

15.3 No Waiver

Our failure to enforce any right does not waive that right.

15.4 Assignment

We may assign these Terms. You may not assign your rights without our consent.
